This workshop will focus on the parallels and differences between the Social Security disability program and private disability insurance, with an emphasis on medical criteria, vocational concerns, and the interaction between Social Security and private disability benefits. The emphasis is on using skills learned from managing Social Security claims to presenting and winning claims under commercial disability insurance policies (group and individual disability).
Mark DeBofsky is a founding member of the Chicago-based legal firm DeBofsky Sherman Casciari Reynolds P.C. He primarily represents claimants and plaintiffs in employee benefit claim disputes concerning disability insurance, life insurance, health insurance, retirement, long-term care, and other employment and employee benefit-related issues. Mark DeBofsky has been an adjunct professor at John Marshall Law School in Chicago, Illinois, since 2000, and a regular columnist for the Chicago Daily Law Bulletin since 2003. He has also been the editor and publisher of the Disability E-News Alert, a monthly newsletter analyzing recent developments in the area of disability insurance and related issues, since 2001. DeBofsky has written numerous journal articles and frequently speaks at legal symposia sponsored by national, state, and local legal organizations such as the American Bar Association, American Association for Justice, American Conference Institute, and the Illinois Institute for Continuing Legal Education. DeBofsky has been designated by SuperLawyers as one of the Top 100 Lawyers in the State of Illinois; he has also been recognized by the Leading Lawyers Network and the Top 100 Trial Lawyers. Mark DeBofsky graduated from the University of Michigan in 1977 and the University of Illinois College of Law in 1980. He is licensed to practice law in Illinois and Hawaii, as well as by the United States Supreme Court and the United States Courts of Appeals for the Third, Seventh, Eighth, Ninth, Eleventh, and Federal Circuits, as well as various federal district courts.

Martina Sherman – Martina Sherman is a shareholder in DeBofsky Sherman Casciari Reynolds P.C., where she defends individuals in ERISA and insurance benefit disputes. Ms. Sherman has expertise in both employment and Social Security law, allowing her to provide clients a complete approach to benefit issues. Ms. Sherman assists clients at all stages of litigation, from pre-suit consulting to trial and appellate proceedings. She has substantial expertise in federal court and has successfully argued before the Seventh Circuit Court of Appeals. Ms. Sherman is a frequent lecturer on employee benefits at American Bar Association national conferences. Ms. Sherman is also a member of the Chicago Bar Association (CBA), where she has served as head of the CBA Young Lawyers Section Health & Hospital Law Committee and as a Legislative Liaison to the CBA Social Security Law Committee. She also volunteers at Equip for Equality, an Illinois-based legal advocacy group for individuals with disabilities. Since 2016, she has been designated an Illinois Super Lawyer Rising Star. Ms. Sherman graduated from Chicago-Kent College of Law in 2011 and Columbia College, Columbia University in 2005.
